Toby Morton Press Release/Rep. Lauren Boebert

Tulsa, OK - November 17, 2021. Attorney Richard Painter, former White House chief ethics lawyer in the George W. Bush administration, and Attorney John “Jack’ Alden announced today that Toby Morton, a comedian and documentary filmmaker requested in October 2021 that the United States Attorney’s Office, District of Colorado, the Colorado Attorney General, and the Office of Congressional Ethics conduct investigations of Representative Lauren Boebert (R-CO3) stemming from her interactions with Mr. Morton in May and July of 2021.

Pursuant to notice requirements set forth in House Resolution 503, the

House Select Committee to Investigate the January 6th Attack on the United States Capitol was also advised of these correspondences. Morton has requested that Rep. Boebert be subpoenaed by the committee for information about her use of Colorado law enforcement to gather information on her political opponents and use of DC law enforcement for personal and political favors.

A request for a pattern and practice civil investigation against Colorado law enforcement agencies has also been filed with the Colorado Attorney General under the authority set forth in Colorado Senate Bill 20-217, and with the United States Attorney’s Office pursuant to 42 U.S.C. § 14141 (Law Enforcement Misconduct Statute). Mr. Morton has been advised that Rep. Boebert’s conduct is also in potential violation of the following laws including, but not limited to 18 U.S.C. § 241 (Conspiracy against rights), 18 U.S.C. § 242 (Deprivation of rights under color of law), 42 U.S.C. § 14141 (Law Enforcement Misconduct Statute), 18 U.S.C. § 2261 (A) (2) (Stalking), Colorado Rev. Stat. § 18-9-11 (Harassment), Colorado Rev. Stat. § 18-8-404 (Official Misconduct), Colorado Rev. Stat. § 18-8-405 (Second Degree Official Misconduct), Colorado Rev. Stat. § 18-8-

402 (Misuse of Official Information).

Mr. Morton's complaint alleges, among other things, that when he lawfully was filming a documentary on public property outside Shooters Restaurant in Rifle, Colorado, Rep. Boebert, the owner to the restaurant, called local law enforcement in an attempt to get him to leave the location. It’s further alleged that a law enforcement officer then inputted the license plate number of a car belonging to Morton's cameraman into a database to get the owner's name, which was given to Rep. Boebert and then disseminated by her or her staff on the Internet for purposes of intimidating the cameraman who now fears for his safety.

Recently, it has been reported that Florida law enforcement used a federal database to make up criminal intelligence bulletins of individuals who have objected to Governor Ron DeSantis’ policies. The Morton case in Colorado also highlights the need for comprehensive investigations making corrupt law enforcement officials accountable under criminal law as well as the imposition of civil and administrative sanctions and other remedies. Elected officials and law enforcement agencies are not above the law. Use of private information in law enforcement databases for political purposes or for intimidation is illegal.

Mr. Morton is aware that under the June 2021 decision by the United States Supreme Court in Van Buren v. United States where a 6-3 majority held that a corrupt law enforcement officer who provided personal information from a police database to an undercover FBI informant could not be prosecuted under the Computer Fraud and Abuse Act and its definition of “exceeds authorized access.” But that decision does not preclude prosecution under state law, or imposition of administrative penalties including dismissal of law enforcement officers responsible for such abuse of power.

As the Morton correspondence with the House Select Committee noted: “If the actions Steve Bannon allegedly committed leading up to and on January 6, 2021, are a public example of what this committee believes is grounds for a subpoena, then clearly the conduct cited herein regarding Representative Boebert’s conduct

meet or exceed that benchmark.”
